User Agreement / Terms of Service

Welcome to Inclusive Labor Institute! These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms1 and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform.2

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional terms3 and conditions or policies referenced herein4 and/or available by hyperlink. This includes, but is not limited to, our Privacy Policy.

2. Purpose of the Platform

The Platform is designed to empower grassroots labor organizations and related entities to conduct effective data collection and surveys, understand worker needs, identify trends, facilitate organizing, and support policy and advocacy efforts.

3. User Accounts and Registration

  • Eligibility: You must be at least 18 years old and capable of forming a binding contract to use the Platform.
  • Account Information: When you register for an account, you agree to provide accurate, current, and complete information as prompted by the registration form.5 You agree to maintain and promptly update this information6 to keep it accurate, current, and complete.
  • Account Security: You are responsible for maintaining the confidentiality of your account7 password and are solely responsible for all activities that occur under your account. You agree to notify Inclusive Labor Institute immediately of any unauthorized use of your password or account or any other breach of security.
  • Organizational Accounts: If you are creating an account on behalf of an organization, you represent and warrant that you have the authority to bind that organization to8 these Terms.

4. User Responsibilities and Conduct

You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use9 and enjoyment of the Platform.10 Specifically, you agree not to:

  • Misuse Data: Collect, store, or process data in a manner that violates applicable privacy laws (e.g., GDPR, local data protection acts) or ethical guidelines.
  • Upload Prohibited Content: Post, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous,11 invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Infringe12 Rights: Infringe any intellectual property rights or other proprietary rights of any party.
  • Harm the Platform: Transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Interfere: Interfere with or disrupt the Platform or servers or networks connected to the Platform.
  • Impersonate: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or13 entity.
  • Ethical Data Collection: Ensure that all data collection activities, including surveys and focus group discussions, are conducted with the informed consent of participants and in a manner that respects their dignity and privacy.

5. Intellectual Property

  • All intellectual property rights related to the ILI website, including but not limited to trademarks, copyrights, and patents, are owned by ILI, its partners or its licensors.
    Studies, reports, trainings and other materials hosted on the platform are conducted with support from ILI. The views and opinions expressed in these materials are those of the respective authors and do not necessarily reflect the views or endorsement of ILI
  • Survey Tools & Guides: The ILI guides, survey tools, and templates provided on the Platform are for your use in conjunction with the Platform's services. You may use, adapt, and distribute these materials for your organizational purposes, provided you acknowledge their origin and adhere to the terms of any specific licenses attached to them.

6. Data Privacy and Confidentiality

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review our17 Privacy Policy. to understand our practices regarding the collection, use, and disclosure of your personal information and the data you collect through the Platform. You are responsible for ensuring your data collection practices comply with relevant privacy laws.

7. Disclaimers and Limitation of Liability

  • "As Is" Basis: The Platform is provided on an "as is" and "as available" basis. Inclusive Labor Institute makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, materials, or products included on the Platform.18
  • No Warranty: Inclusive Labor Institute does not warrant that the Platform will be uninterrupted or error-free, nor does it make any warranty as to the results that may be obtained from19 the use of the Platform, or as to the accuracy, reliability, or content of any information or service provided through the Platform.20
  • Limitation of Liability: To the full extent permissible by applicable law, Inclusive Labor Institute disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Inclusive Labor Institute will not be liable for any damages of any kind arising from the use of the Platform, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.21

8. Indemnification

You agree to indemnify, defend, and hold22 harmless Inclusive Labor Institute, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms23 or your use of the Platform.

9. Termination

Inclusive Labor Institute reserves the right to terminate or suspend your account and access to the Platform, without prior notice or liability, for any reason24 whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will immediately25 cease.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material,29 we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the30 revised terms.
